Garden Waste Service - Terms And Conditions


This agreement is made between the resident (the customer) and Wolverhampton City Council (the Council) and sets out the terms and conditions under which the customer may use the Council’s Garden Waste Collection Service (referred to as the Service).

 

  1. Service Description

1.1 The Service will run for 42 weeks a year between February and December. The council provides a 240-litre wheeled bin to the customer for the disposal of garden waste. The bin will be emptied every two weeks (fortnightly). The bin remains the ownership of the council and is provided to the customer during the 42-week subscription period only.

 

  1. Service Eligibility

2.1 The Service will be available to households within the boundaries of the city of Wolverhampton. Commercial businesses are not eligible for the Service.

 

  1. Subscription Cost and Concessions

3.1 Sign-up for £38 per year for each bin. There will be no discount for customers who sign-up part way through a year and no refunds for cancelling part way through the year.  

3.2 A concession may be provided at the council’s discretion. This concession will apply to the first bin only, any further bins required will be at full cost. Concessions will be applied at application.  No refunds will be available for customers who become eligible for a concession at a later date, after they have signed-up.

3.3 The council will guarantee the price of the Service is fixed for the year of the subscription. However, the council will review the service charge annually and may offer reduced rates.

 

  1. Renewing Subscriptions

4.1 We will notify all customers either by email, SMS or letter when their subscription is due for renewal.

4.2 Subscription renewal is the responsibility of the Customer.  If you do not renew your subscription by the advertised renewal date your garden waste will no longer be collected.  Your garden waste bin may be removed.

 

  1. Refunds

5.1 Refunds for the Service will only be considered in the following circumstances:

- During the statutory 14 day cooling-off period after you sign-up for the service.

- If the council in its absolute discretion deems your property to be unsuitable for the garden waste collection service because of practical or health and safety reasons, which restricts or does not allow for the bin to be put out by the customer and emptied by the bin crew.

 

  1. Moving House

6.1 . If you move to a new house within Wolverhampton, and want to continue with the garden waste service, you must contact us with your new address. Once we’ve received it, we’ll send you a new bin and sticker if there isn’t one already at the property. When moving, please leave your bin at your old property. To arrange this, go online to -  https://www.wolverhampton.gov.uk/ and go to the ‘My Account’ section.

6.2 If you move house outside of Wolverhampton you must contact us and give us your new address as soon as possible. To do this, go online to - https://www.wolverhampton.gov.uk/ and go to the My Account’ section. You will not be able to receive a refund for the subscription fee you have paid for the Service.

 

  1. Cancellation and Withdrawal of Service

7.1 Should you fail to comply with the terms and conditions of this agreement the council has the right to withdraw the Service with immediate effect.

7.2 This agreement will continue until:

(a) You inform the council that you no longer wish to receive the Service

(b) The council withdraws the Service in accordance with condition 7.1

In each case above, there will be no refund for any payments already made by the customer for the year in which the subscription starts and ends.

7.3 The council reserves the right not to provide the Service if your property is unsuitable for garden waste bin collections. If this is the case, a full refund for the subscription payment will be made.

 

  1. The Garden Waste Bins and Licence Stickers

8.1 The council will provide a 240-litre purple bin for the customer’s use.

8.2 A garden waste sticker will be issued every year for each subscription. Garden waste bins put out for collection without a valid subscription sticker will not be emptied.

8.3 The bin must display the subscription sticker provided by the council upon payment of the annual charge. It is the responsibility of the customer to display the sticker underneath the handle on the body of the wheelie bin so it’s visible from the roadside.

8.4. Bin Sticker Deliveries: you already have a bin(s)

    • Your sticker will be sent to you within 28 working days from when you sign up to the new service year.

Bin Deliveries: where the service is new, and you don’t have a purple bin or if you have ordered additional bin(s)

    • You will receive the bin(s) with sticker(s) within 28 working days.

8.5 The council reserves the right to make a charge covering administration and delivery for the replacement of lost, damaged, or stolen garden waste bins and stickers.

8.6 Only bins supplied by the council can be used and collected for this Service. The council accepts no liability for supplied garden waste bin(s) being used for any other purpose. The council may also remove misused containers.

8.7 Neighbours may share a garden waste bin. This will be deemed a private agreement between you and your neighbour(s). The customer named on the subscription has full responsibility for the bin. A bin can only be allocated to one address. It is the responsibility of the named householder if the bin is contaminated, misused, or needs replacing.  The council is not responsible for arrangements or disputes resulting from any such agreements. The Council will only correspond with the address for which the subscription is held.

8.8 The bins provided for the use of customers remain the property of the council and must be returned to the council on the expiry or termination of the Service.

8.9 The service is not transferrable to another bin or address outside of Wolverhampton. (see section 6).

 

  1. Acceptable Material and Contamination

9.1 Garden waste bins that contain unacceptable waste will not be emptied. Any unacceptable waste will need to be removed by the customer before the next collection date. Only waste accepted by the council may be placed in the garden waste bins. Any other items placed in the bin are considered unacceptable waste. The council reserves absolute discretion to determine whether any waste is unacceptable. Information about acceptable waste material can be found at www.wolverhampton.gov.uk/recycling-and-waste

9.2 In the event of repeated attempts to use the Service for the disposal of non-permitted waste, the council will, if necessary, withdraw the Service without any refund.

 

  1. Putting out Garden Waste for Collection

10.1 Garden waste should be placed loose in the bin (not in bags) and the bin put on the kerbside outside your property before 7am on the day of collection. No side garden waste will be collected. Garden waste bins must not be overfilled, and lids must close. If the bin is too heavy for bin crew to move, it will not be emptied.

Where the garden waste bin was not presented before 7am or contains unacceptable waste the crews will not return.  The garden waste bin will be emptied on the next scheduled collection date if it contains only acceptable garden waste.

Where the garden waste bin(s) was not emptied because, it was too heavy to safely move onto the vehicle lifting equipment, the contents were too compacted to eject fully into the vehicle, or frozen, your bin(s) will be not be emptied until your next scheduled garden waste collection date. No refunds will be available if we are not able to empty your garden waste bin(s) for these reasons.

Due to the mechanical methods used to empty bins, it is a requirement that bins are presented with the lids in the closed position. The Council reserves the right to suspend or cancel the service to customers who fail to put the bins out with the lids closed. No refunds will be available if we are not able to empty your garden waste bin(s) for this reason.

10.2 The council reserves the right to alter the collection day, (e.g. public holidays, industrial action) but will provide adequate notice to customers of any changes.

10.3 If you receive assisted collection, your garden waste bin will be collected from your property in the same way your other bins are collected.

10.4 In the event of missed collections (where garden waste bins have been put out before 7am and contains only acceptable garden waste) please use the ‘Report a missed bin’ facility. This can be found at: www.wolverhampton.gov.uk/recycling-and-waste

It is your responsibility to report a missed bin within 2 working days from the original collection day. You cannot report a missed bin on the same day as your scheduled collection day. The bin crew will return at the earliest opportunity to empty the bin if the missed bin was missed as a result of a service failure.

Where the garden waste bin was not presented before 7am or contains unacceptable waste the crews will not return.  The garden waste bin will be emptied on the next scheduled collection date if it contains only acceptable garden waste.

10.5 The council reserves the right to suspend the collection of garden waste in cases of severe weather or unforeseeable circumstances. This includes, but is not limited to riot, war, civil commotion, natural disaster, infectious disease control, strike or industrial action. Or any other event which is beyond the reasonable control of the council. On such an occasion, the council will make reasonable endeavours to collect the garden waste at the next reasonable opportunity. The council does not refund customers in these instances. In the event of service disruption, we will provide information on our website and social media channels.

 

  1. Statutory Right to Cancel

11.1 The customer has 14 days (the ‘cooling-off period’) from signing up to the Service, to cancel the Service for a full refund. This must be done online at https://www.wolverhampton.gov.uk/ and go to the ‘My Account’ section. No refunds will be given for cancellation requests received after 14 days of signing up to the Service.

12.1 We (the council) will ensure your personal data (information about living individuals) remains private and is updated to our systems in a timely and accurate manner.   1. Jurisdiction

13.1 These terms and conditions are construed in accordance with the law in England and Wales and will be subject to the exclusive jurisdiction of the courts of England.

13.2 If any part of these terms and conditions are found to be unenforceable, the remainder of the terms and conditions shall remain in force as far as the law allows.

 

  1. Variations

14.1. The Council reserves the right to vary terms and conditions at any time.

 

  1. Direct Debits

15.1 Your direct debit will be taken from your bank account annually. The payment will appear on your bank statement as Wolverhampton CC.

15.2 The garden waste service runs from February to December and costs £38 regardless of which month you join. If you choose to pay by direct debit your payment will start from the month you sign-up until the service ends in December.

15.3 To make sure customers get the maximum number of collections for future service years, direct debit customers will have a payment taken on or around 15 November or 1 December depending on the payment date you choose.

15.4 Direct Debit Guarantee

All payments made by Direct Debit are covered by the Direct Debit guarantee.

  • This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits

  • If there are any changes to the amount, date or frequency of your Direct Debit Wolverhampton City Council will notify you 10 working days in advance of your account being debited or as otherwise agreed. If you request Wolverhampton City Council to collect a payment, confirmation of the amount and date will be given to you at the time of the request

  • If an error is made in the payment of your Direct Debit, by Wolverhampton City Council or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society

    - If you receive a refund you are not entitled to, you must pay it back when Wolverhampton City Council asks you to

  • You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify us.

 

 

15.5 Rejected Direct Debit Payments

Payments that are rejected by the customers bank account for any reason will not be re-submitted for payment. The customer will be notified in writing and have seven working days to pay by bank card to continue with the existing subscription.

If payment is not made within seven working days, the subscription will cancel, and a new subscription application will be required.
