This agreement is made between the resident (the Customer) and Wolverhampton City Council (the Council) and sets out the terms and conditions under which the Customer may use the Council’s garden waste collection Service (the Service).
1.1 The garden waste service will run for 42 weeks a year, between February and December. The Council will provide a 240-litre wheeled bin for you as a subscribing Customer for the disposal of your garden waste, which will be emptied once in every two weeks (fortnightly). The bin provided will remain in the ownership of the Council and is provided for the Customer to use during the subscription period only.
2.1 The Service will be available to households within the boundaries of the City. Commercial businesses are not eligible for the Service.
3.1 The Service will cost £35 per year for each garden waste bin. There will be no discount for customers signing up part way through a year.
3.2 A concession may be provided at the Council’s discretion. This concession will apply to the first bin only and any further bins required will be at full cost. Concessions will be applied at application.
3.3 The Council will guarantee that the price of the Service is fixed for the subscription year. However, the Council will review its Service charge annually.
4.1 Customers paying by card will be notified by email and through ‘My Account’ when their subscription needs renewing. Subscription renewal is the responsibility of the Customer. If you do not renew your subscription, the garden waste bin supplied to you will be collected and your garden waste will no longer be collected. We will make arrangement to collect your bin.
5.1 Refunds for the service will only be considered in the following circumstances:
- During the statutory 14 day cooling off period after payment is made.
- If the Council deems your property to be unsuitable for a garden waste collection due to practical or health and safety reasons of bin presentation and emptying.
6.1 If you move house within the City you must inform us via your online ‘My Account’ of your new address and take the bin with you.
6.2 If you move house out of the City you must inform us via your online ‘My Account’ as soon as possible. You will not be able to receive any refund on the subscription fee you have paid.
7.1 Should you fail to comply with the terms and conditions of this agreement the Council has the right to withdraw the Service with immediate effect.
7.2 This agreement shall continue in force until:
(a) You inform the Council that you no longer wish to receive the Service;
(b) The Council withdraws the Service in accordance with 7.1
In each case above there shall be no refund of any payments already paid by you for the year in which the subscription ends.
7.3 The Council reserves the right not to provide the Service if your property is unsuitable for wheeled garden waste bin collections. A full refund of subscription payment will be made in this event.
8.1 The Council will provide a 240-litre bin, for your use.
8.2 A garden waste licence sticker will be issued each year for each subscription. Garden waste bins presented without a valid subscription sticker will not be emptied.
8.3 The wheelie bin must display the subscription sticker that is issued by the Council upon payment of the annual charge. It is the responsibility of the Customer to display the subscription sticker underneath the handle on the body of the wheelie bin and be visible from the roadside.
8.4 With the exception of the initial launch and sign up of the scheme, garden waste bins will be delivered within 28 working days of signing up to the service and you will be informed of the date of first collection. The initial launch and sign up predicts delivery of bins before the commencement of the service in February as long as the application has been made prior to the 31 December.
8.5 The Council reserves the right to make a charge covering administration and delivery for the replacement of lost, damaged or stolen garden waste bins and licence stickers.
8.6 Only garden bins supplied by the Council are to be used. The Council accepts no liability for supplied garden waste bin(s) being used for any other purpose. The Council may remove misused containers.
8.7 Neighbours may share a garden waste bin, and this will be deemed a private agreement between you and your neighbour(s). The customer named on the subscription will have full responsibility for the bin and a bin can only be allocated to one address. It is the responsibility of the named householder if the bin is contaminated, misused or needs replacing. The Council shall not be responsible for any arrangements or disputes resulting from any such agreements.
9.1 Garden waste bins that contain unacceptable waste will not be emptied and the waste will need to be removed before the next collection date. Only waste of a kind advised by the Council on the website referred to below may be placed in the garden waste bins. Any other items placed in the bin will be deemed to be unacceptable waste and the Council reserves absolute discretion to determine whether any waste is unacceptable waste.
9.2 In the event of repeated attempts to use the Service for the disposal of non-permitted waste, the Council will, if necessary, withdraw the Service without any refund.

10.1 Garden waste should be placed loose in the supplied bin and presented for emptying on the kerbside outside of your property before 7am on the day of collection. No side garden waste will be collected. Garden waste bins must not be overfilled and lids must close. If the bin is too heavy for collection staff to move it, it will not be emptied.
10.2 The Council reserves the right to alter the collection day but will provide adequate notice to customers of any changes (e.g. Public Holidays, Industrial Action).
10.3 If you have an assisted collection your garden waste bin will be collected from your property as per your other bins.
10.4 In the event of missed collections (where garden waste bins have been presented before 7am and contain only acceptable garden waste) please use the ‘Report a missed bin’ facility at: www.wolverhampton.gov.uk/recycling/
10.5 The Council reserves the right to suspend the collection of garden waste in cases of severe weather or other incidences or force majeure including but not limited to riot, war, civil commotion, natural disaster, strike or industrial action or any other event which is beyond the reasonable control of the Council. On such an occasion the Council will make reasonable endeavours to collect the garden waste at the next reasonable opportunity. The Council will not make any refund of subscription to customers in these instances.
11.1 The customer has 14 working days (the ‘cooling off period’) from making payment, to cancel the Service for a full refund; notice of this must be made via your online ‘My Account’. No refunds will be given for any cancellation requests received after 14 working days of making payment.
12.1 We (The Council) will not collect information about you that we do not need and we will ensure that the personal data (information about living individuals) we collect is updated to our systems in a timely and accurate manner. 13.1 These terms and conditions will be construed in accordance with the law in England and Wales and will be subject to the exclusive jurisdiction of the courts of England.
13.2 If any part of these terms and conditions are found to be unenforceable the remainder of the terms and conditions shall remain in force as far as the law allows.
14.1 The Council reserves the right to amend or vary these terms by written notice to the Customer.
